고용주들의 허위 실업수당 신청 처벌

많은 한인 고용주들이 스스로 그만 둔 직원이 실업수당을 받게 하기 위해 실업수당보험 (UI) 신청 용지에 해고했 다고 적는 경우가 많다.

실업수당은 해고를 당해야만 받을 수 있지만 직원이 받게 해달라고 요청 하면 대부분의 한인 고용주들은 EDD에 그렇게 허위 신고를 한다. 문제는 이렇게 실업수당 허위 신청을 했을 경우 적발되면 벌금 뿐만 아니라 징역형까지 받을 수 있으니 조심해야 한다.

더구나 이런 경우 고용주들이 불법인 줄 알면서도 의도적으로 거짓으로 실업수당 허위 수령에 동조하는 사기 (fraud) 행위이기 때문에 중벌 을 받을 가능성이 높다. 또한 나중에 직원이 부당해고 소송을 할 경우 고용 주는 이 직원이 사직했다고 주장할 수 없기 때문에 불리하다.
다음과 같은 UI 허위 신청은 보험 사기에 해당되기 때문에 강한 처벌을 받는다. (1) 작장에 복귀한 뒤에도 EDD에 보고하지 않고 UI 수령 (2) EDD에 거짓 정보를 제공하기. 이렇게 UI 사기를 저지를 경우 (a) 미래에 UI를 받을 수 있는 자격 박탈 (b) 받았던 UI를 벌금 과 함께 갚기 (c) 정부에 의해 기소 당할 수 있다.

EDD와 캘리포니아 주지사 사무실은 팬데믹 기간 동안에 UI 사기가 급증해서 2021년에서 2022년 사이 에 UI 사기를 저지른 1400건을 조사해서 370명을 체포하고 130건을 기소했을 정도로 정부의 사기 적발 의지는 강하다.

UI 조항 2101에 의거해 UI 사기로 경범죄로 기소될 경우 최고 2만 달러의 벌금이나 최고 1년의 징역 형을 받을 수 있고 중범죄로 기소될 경우 최고 2만 달러의 벌금형이나 16개월에서 최고 3년의 징역 형을 받을 수 있다.

또한 검찰은 형법 550 (c) 조항에 의거해 사기 금액이 $950 보다 적으면 경범죄로 최고 1,000 달러 벌금형이나 최고 6개월 징역형을 UI 2010 조항에 의거한 처벌에 추가할 수 있고, 사기 금액이 $950 보다 많으면 1만 달러 벌금형과 최고 1년 징역형을 추가할 수 있다. 형법 550 조항에 의거 한 중범죄로 기소될 경우 최고 5만 달러의 벌금이나 사기 금액의 두배 금액, 그리고 2-5년 징역형이 추가될 수 있으니 조심해야 한다.

이밖에도 가능할 경우 절도, 위조, 위증, 음모죄 등의 범죄들이 추가될 수 있고 이에 대한 처벌이 적용될 수 있다. 즉, UI를 신청했다는 통지서를 EDD에서 받았을 경우 고용주 가 해고라고 거짓 정보를 EDD에 제공할 경우 위증죄에 해당된다.

UI 조항 2101에서 사기로 보는 행위는 가짜 이름, 소셜번호, 아이디 사용하기, 해고가 아니라 사직이 라는 UI 신청에 중요한 정보를 보고 안 하기. UI 신청 기간 동안에 받은 임금 보고 안 하기 등이 포함된다.

아무리 고용주가 전 직원이 UI를 받게 하도록 도와주겠다는 선의의 의도였다 하더라도 주 정부에 사기를 의도적으로 알면서 저지를 경우 그리고 그 직원의 상태에 대해 거짓말을 하면 처벌을 받게 된다. 그렇기 때문에 이유가 뭐라 하더라도 고용주들은 EDD에 해고가 아니라 직원이 스스로 그만 뒀다고 보고해야 한다.그럴 경우 EDD는 고용주와 전 직원 양측을 전화를 통해 조사하고 회사를 떠난 이유가 다를 경우 히어링을 갖게 된다. 이럴 경우 많은 고용주들은 이 직원이 UI를 받게 하기 위해 히어링에 참석하지 도 않고 대응도 안 한다. 이 또한 UI 액수가 많고 적고와 상관 없이 이 직원의 UI 사기에 동조하는 공범이 되고 형법과 민사상의 벌금형을 받을 수 있다는 점을 유의해야 한다.

대부분의 경우 단기간 동안 UI를 받았다면 받았던 UI를 EDD에 환불하는 방식으로 종결지만 장기간 동안 허위로 UI를 받았다면 추가의 이자와 벌금을 내야 하거나 실형을 받게 된다.

마지막으로 독립계약자로 잘못 분류된 직원이 EDD에 UI를 신청하면 페이롤 택스 미납과 관련된 EDD 감사를 받는다. 점점 독립계약자로 분류하기 힘들기 때문에 이들이 UI를 신청하는 사태가 발생 하기 전에 종업원으로 분류해서 제대로 페이롤 택스를 지불해야 EDD 감사를 피할 수 있다.

친한 선배가 오렌지 카운티에서 식당을 오래 하면서 상해 보험과 노동청 클레임, 노동법 소송, 직원들의 수많은 결근, 지각, 태만으로 고생했다. 그래서 종업원으로 생긴 골치로 인해 팬데믹 때 눈물을 머금고 정든 식당을 닫고 쉬었다. 그러다가 직원 문제가 거의 없 는 리커스토어를 오렌지카운티에 작년에 오픈했다. 그런데 이번 엔 지붕을 뚫고 들어오는 좀도둑의 피해를 두 번이나 당했다. 일요일 대낮에 밧줄을 타고 내려와 복권, 현금, 담배 등을 훔쳐 나가는데 3분 밖에 안 걸렸다. 그러나 시 경찰, 가주 복권국, 오렌지카운티 셰리프국 CSI까지 출동해도 범인 체포 소식은 감감, 이 와중에  또 도둑을 맞았다.    

지금 남가주는 사방에 절도범 천지다. 필자는 한인타운내 샌드위치 가게와 편의점에 노숙자들이 들어와 팁 통에서 팁을 훔쳐가거나 물건을 훔치는 현장을 직접 목격했다. 오렌지카운티의 클라이언트 식당에 갔다가 노숙자가 먹다 남은 반찬 그룻을 대낮에 들고 나가는 것도 봤다. 

한인타운 뿐만 아니라 사우스코스트플라자 구찌와 센추리시티 몰 구찌 매장, 글렌데일 아메리카나 이브생로랑 매장, 토팽가 노드스트롬, 행콕파크의 청바지 가게, 이스트 LA 나이키 매장 등에서 ‘플래시 몹’ 떼강도들이 들끓고 있다.    

업소에 도둑이 들어서 종업원이 다쳤을 경우 상해보험을 신청할 수 있고 상해보험이 없다면 민사소송도 당할 수 있기 때문에 조심해야 한다. 그리고 도둑이 들었을 때 잘못 대응하면 직원이나 고객 뿐만 아니라 도둑이 다쳐도 고용주가 소송을 당할 수 있다. 그래서 조지아주의 룰루레몬 매장은 지난 6월 도둑과 몸싸움을 하고 경찰에 신고한 직원 2명을 해고했다. 룰루레몬측은 그 이유를 해고된 직원들이 회사 방침을 어기고 가게 밖으로 도둑을 따라 나가 도둑들과 싸웠다면서 “직원들이 도둑을 잡다가 다치거 나 심한 경우 사망하는 사례를 본 적이 있기 때문”이라고 설명했다. 

전미소매업연합회(NRF)에 따르면 좀도둑, 사기 등으로 인한 재고 손실은 2020년 910억 달러에서2021 년 950억 달러로 증가했다. 떼강도들을 체포하기 위해 LAPD와 LA 셰리프국, 캘리포니아 고속도로 순찰대, 글렌데일과 버뱅크 경찰, 베벌리 힐스와 샌타모니카 경찰, 연방 수사국 FBI에서 배치된 22명으으로 구성된 태스크포스가 지난주 발족 했고 LA 카운티와 시 검찰, 캘리포니아주 법무부 소속 수사관들도 포함됐다. 

그런데 범인을 잡으면 뭐하나? 무 보석금석방 제도로 금방 풀려나는데. 실제 아메리카나 쇼핑몰의 떼강도 용의자 30명 중 1명이 체포됐지만, 하루도 안 돼 풀려났다.  

지난 16일밤에는 LA 일대 6군데 타코 트럭이 2시간 사이에 모두 도둑을 맞았다. 이 절도범 들은 타코 트럭 종업원들의 주머니도 털었다. 이렇게 현금을 가게에 두는 것이 위험한데도 LA 한인타운을 관할하는 헤더 허트 10지구 시의원은 현금 결제를 거부하는 행위가 계좌를 개설하거나 카드를 만들 수 없는 주민들에 대한 차별로 이어질 수 있다며 현금 없는 매장 금지안을 발의했다. 카드나 모바일 결제만 허용하는 매장을 금지하는 안은 고용 주와 종업원들의 안전을 전혀 고려하지 않고 한쪽 입장만 생각하는 눈 먼 발의안이다.

허트 시의원은 모든 계층의 사람들에게 공평하고 평등한 서비스가 제공되야 한다고 말 했는데 과연 허트 시의원이 LA의 떼강도 사태를 방지하는 법안은 발의했는지 궁금하다.

현금 지불을 선호하는 소비자들에게 결제수단을 자유롭게 선택할 권리가 있을 뿐만 아니라 업주와 종업원들도 떼강도로부터 보호를 받을 권리가 있다는 사실을 정치인들은 망각하지 말아야 한다.

Koreatown workers are fighting for unions. Why do essential workers still lack basic protections?

There are few better salves for the pain of a cross-town drive than the prepared food sections of Koreatown grocery stores.

At Hannam Chain, I’ve been trying to settle on a favorite kimchi brand and sampling different types of banchan, small side dishes, made fresh and featuring a wider variety of vegetables than I’m used to.

Recently I met the woman who works in the kitchen where the food is prepared.Technically, she used to work there, until the department was eliminated and outsourced. One day, Antonia Gonzalez was handed a list of product codes to memorize and given a new job. She was encouraged to view the cashier position as a promotion, but the pay was the same.

Gonzalez is a single parent caring for an autistic son, and felt she had no choice. She learned the product codes. There was no training, and her manager often snapped at her for asking questions. She struggled to deal with inebriated customers trying to buy alcohol, and her manager once threatened to fire her for bringing up the cockroaches she dodged at night.Now she and other workers at Hannam Chain are seeking a union.

Scott Witlin, an attorney representing Hannam Chain, said the Koreatown Immigrant Worker’s Alliance used improper tactics to manipulate workers into supporting the union.

“This group has been flouting the law and making fraudulent claims about a number of Asian-owned businesses,” Witlin said.This summer we’ve seen celebrities, TV writers, hotel employees, baristas and warehouse workers hit the picket lines. Many of us can no longer ignore that our lopsided economy seems designed to concentrate wealth in the hands of a few.

And the pandemic’s quarantine conditions exposed us to the reality that the workers at the bottom rungs of our economy are indispensable and often exploited. So we can’t be surprised that immigrant wage workers are demanding more.Last year, workers and management at Genwa Korean BBQ ratified what organizers say is the first labor contract at a Korean restaurant in the United States. And a few months ago, a majority of the 157 workers of the American branch of Coway, a South Korean manufacturer of air purifying appliances, successfully voted for a union.

Note that each of these union battles is taking place in industries labeled essential during the pandemic: Restaurant workers, air filtration technicians and grocery employees. The bonhomie that spurred us to bang pots and pans in solidarity with the pandemic’s essential workers has not helped improve their conditions.

Latino workers experience labor law violations at nearly four times the rate of white workers, according to a KIWA survey. Foreign workers are more than twice as likely to experience wage theft, according to a 2010 UCLA study.At Hannam Chain, workers allege that only employees of Korean descent get promoted, and I’ve heard similar complaints at businesses all over Koreatown.

Coway offers the type of job you might take if you are an immigrant who hopes to spend more time with your children and save up money for their college tuition. It is one of the largest air purifier companies in South Korea, with annual revenue often topping $3 billion, a publicly traded company that even enlists BTS to promote its products. Plus the hours are flexible, and the company offers commission.

A Coway maintenance worker’s duties include customer service, sales and upkeep of the company’s air filtration units that are available for rent. The work often adds up to more than 40 hours a week, but Mimi Deboer and other employees said they earn the salary and benefits of part-time workers.

Commission payments might help make up the difference, but workers allege the company withholds money for a variety of reasons. If the company wanted to offer a promotion on air filters, workers say, that came out of workers’ commission checks. It expected workers to help pay part of the customer’s fees with their commission, said Deboer. And raises almost never happen. Eunae Park, who has toiled there for seven years says she’s only gotten one 50-cent raise in that entire time.Beyond pay issues, workers feel mistreated, undervalued and exploited. Deboer said they were being asked to enter customers’ apartments to clean and replace filters, but the company did not provide them with their own protective gear.

“During the pandemic, the company made more money than ever, but we didn’t get any benefit whatsoever,” Deboer said.

Though workers voted for a contract, union organizers say Coway hasn’t responded to any of their contract proposals for nearly a year. Coway did not return a call requesting comment.When I wrote about labor abuses at Korean barbecue restaurants in 2019, I tried to explain that many business owners are themselves immigrants and renters, caught in a system of exploitation they did not create.

But the owner of Hannam Chain grocery stores is Dr. Kee Whan Ha, one of the richest men in Koreatown. He is known for his Korean-language radio broadcasts during the L.A. riots in 1992 exhorting merchants to defend their businesses. He also is the president of Hankook Property Management, a company that owns properties all over Koreatown.

And Coway is a profitable company, according to its quarterly financial filings. Such businesses and business owners should be able to afford to treat their workers right.

“These workers are just saying, we are holding up this economy,” said Alexandra Suh, executive director of Koreatown Immigrant Worker’s Alliance. “We should be able to benefit from it as well.”These companies should offer sick days, insurance and safe working conditions. These employees do not deserve to be stuck with jobs that exploit and disrespect them.

After our conversation, Gonzalez sat back in her chair and took a deep breath. Her shift began in 10 minutes.

“At first I was so scared, but I became stronger because I desire a change. Everybody has just let management step all over us. And I just think everyone needs to get on board, because the fact is that we all need a change,” Gonzalez said.

Then she walked down the street to the grocery store to spend another day standing behind the register.
