Tesla sued for ‘widespread and ongoing’ racial harassment at California plant

The U.S. Equal Employment Opportunity Commission is suing Tesla Inc. for “widespread and ongoing” racial harassment of its Black employees and for retaliating against workers who spoke out about the problem, the federal agency announced Thursday.

Since at least 2015, “Black employees at Tesla’s Fremont, California, manufacturing facilities have routinely endured racial abuse, pervasive stereotyping, and hostility as well as epithets,” the commission said in a statement.

The EEOC added: “Black employees regularly encountered graffiti, including variations of the N-word, swastikas, threats, and nooses, on desks and other equipment, in bathroom stalls, within elevators, and even on new vehicles rolling off the production line.”

The lawsuit was brought by the EEOC’s San Francisco District Office, which has jurisdiction over Northern California, northern Nevada, Oregon, Washington, Alaska, Idaho and Montana.

EEOC officials said the lawsuit is seeking compensatory and punitive damages “and back pay for the affected workers, as well as injunctive relief designed to reform Tesla’s employment practices to prevent such discrimination in the future.”EEOC Chairperson Charlotte A. Burrows said the lawsuit “makes clear that no company is above the law.”

“The EEOC will vigorously enforce federal civil rights protections to help ensure American workplaces are free from unlawful harassment and retaliation,” she said.

Attempts to reach officials at Tesla for comment were unsuccessful.

Tesla, the world’s most valuable car company, faces similar action on several other fronts.

In February, the California Department of Fair Employment and Housing filed a lawsuit on behalf of more than 4,000 current and former Black Tesla workers — the largest racial discrimination suit ever brought by the state based on number of workers affected.

In that suit, three former employees alleged that racist slurs in English and Spanish were often aimed at Black employees by co-workers and supervisors. They said Tesla segregated Black workers into separate areas, gave them the hardest tasks and routinely denied them promotions. And they alleged that when they informed the company about racist treatment, their complaints went ignored or they were fired.

Tesla disputed the former employees’ accounts, stating that the three workers did not complain to the company about racism and that any discipline they received was the result of their own workplace behavior.

“Race plays no role in any of Tesla’s work assignments, promotions, pay or discipline,” attorneys for the company said in a statement at the time. “Tesla prohibits discrimination, in any form.”

Thursday’s lawsuit puts a different kind of pressure on Tesla, said attorney Clifton W. Albright, founding partner and president of Albright, Yee & Schmit, a labor and employment law firm in downtown Los Angeles.

“The EEOC’s preference is to resolve issues quietly.... They don’t have a dog in this fight,” he said, unlike lawsuits filed by private firms or civil rights organizations.

“For the EEOC to come out so strongly, they must think there is significant evidence that the employer refuses or fails to recognize or address.”

Earning $17 an hour at a Los Angeles Jack-in-the-Box, Anneisha Williams has struggled for years to keep up with rent and bills. The Inglewood native is facing eviction, she said. 

She teared up describing how Assembly Bill 1228, which Gov. Gavin Newsom signed into law in Los Angeles on Thursday, will affect her life by raising her hourly minimum wage to $20 in April.  

More than half a million fast food workers will get the wage increase, most of them minorities and women, Newsom said during the signing event. 

Williiams said she hopes it’ll allow her to save some money and maybe take her six children to Disneyland someday.But not all fast food workers are as hopeful about the financial impact of the new law on their lives. Some workers said the wage hike will allow them to keep up with basic bills and rent, but no more than that. 

“It’s a relief, yes, but our fight continues,” said Laura Pozos, who works in an East L.A. McDonald’s.The average hourly wage for fast food workers in California last year was $16.21, according to a report by the Harvard Kennedy School and UC San Francisco. 

The new law would raise base wages for so-called quick-serve restaurants to at least $20 an hour and create a restaurant industry council that would set future pay raises and advise on working conditions. 

Minimum wage deal

The law is the product of compromise. Restaurateurs agreed to withdraw a proposed November 2024 ballot measure that would have undone a just approved, landmark law creating a fast food industry council. 

In exchange, labor advocates withdrew a proposed bill that would have linked the legal liability of franchisees’ labor violations to the franchisor corporations.

Newsom said negotiating to get the restaurant industry referendum off the ballot was like moving “a tectonic plate.”

“I can assure you, this wasn’t easy,” Newsom said. “It was a profoundly consequential prospect. Tens of millions, hundreds of millions of dollars, would have been spent on that ballot to roll back the progress that the Assembly members had made.”

The law establishes a state-run council for five years, with business and worker representatives and a member of the public. They will set wage standards and advise on work conditions, scheduling, and health and safety standards in fast food restaurants, which labor organizers have mostly failed to unionize. 

The state’s labor and commerce staff can sit in but cannot vote.

Restaurant industry officials said the newly signed law is the best outcome possible. The industry had been preparing to spend $120 million on the referendum.Matt Haller, president of the International Franchise Association, said in a statement  the new law “preserves the franchise business model.” 

“Common sense has prevailed, as franchising is responsible for creating opportunities for hundreds of thousands of people to become small business owners, and this agreement eliminates the existential threats our members faced,” he said.

Working for change

Assemblymember Chris Holden, a Democrat from Pasadena who authored the original and compromise legislation, thanked franchise owners for their willingness to negotiate a deal and the workers who advocated for the law. 

“I saw firsthand all of you who gave your blood, sweat and tears,” he said. “To see so many of you today who were there through the process, knocking on members’ doors, sleeping out on Capitol Park, walking out in the morning with bells and whistles to make sure all of us were paying attention. I say, to God be the glory.” Some workers said they were proud their hard work finally paid off. 

“Little old me, Anneisha Williams, mother of six, never thought I could move mountains with the help and support of so many people,” Williams said. “There were so many people against us that told us ‘No.’ They sent these people out there with this referendum and told us ‘No.’ But guess what? We told them ‘Yes we can.’”

While the wage increase was welcome, some workers said they were more excited about getting a seat at the table with the fast food council, even though the deal pared back some of the council’s power. Now the fast food council has authority over minimum wage increases, but it has an advisory role over other issues.

A living wage?

Pozos, the McDonald’s worker, said that $20 an hour is still not enough to thrive — it won’t even help her save money — but the legislation was about winning against multi-million-dollar corporations like her employer.

Pozos lives with her husband, a teenager and an adult daughter with special needs.  The family struggles to pay the $3,600 rent, she said. 

“This is going to help me to be able to pay the bills with my husband, to have more groceries for my daughters and, more than anything, it’s an important accomplishment since we’ve been going out on strikes, going door to door to talk to legislators, visiting Sacramento for this law to be passed,” she said. But “my life will continue as normal.”In general, $20 an hour is not considered a living wage in California. For a working couple with one child, that would be $23.81 an hour and for a single adult with no children, it would be $21.24, according to the Massachusetts Institute of Technology’s living wage calculator

Pozos said she still hopes her workplace, and the fast food industry in general, will one day be unionized, so workers gain power over schedules and working conditions and can fight workplace retaliation and wage theft. 

Pozos added she is worried that the wage increase will motivate employers to reduce workers’ hours. 

Living free

After Newsom signed the bill, Pozos celebrated with her friend Angelica Hernandez and other workers as a mariachi band played at the Service Employees International Union Local 721 office in downtown Los Angeles.

Hernandez said she was “super happy, super proud” to have supported the legislation. A fast food worker in Monterey Park, Hernandez said she has worked for McDonald’s for 19 years, earned minimum wage at times, and struggled to stay housed. 

“I’ve lived with my children and husband in a car or a cheap hotel that had cockroaches,” she said. “Sometimes I didn’t have enough to feed my children. Honestly, it’s so sad to go through that, to be in a country that is rich in everything and to go through that.” 

Hernandez said a raise from her current $18.18 hourly to $20 won’t be life-changing, but it’ll allow her to buy a candy bar while grocery shopping without overdrawing her account.

“I don’t think I’ll be able to save with this, but I’ll be able to live more freely,” she said.

쿠팡, 코로나 때문에 휴직한 직원 해고해 소송당함

미국 물류시장에 진출한 물류 대기업 쿠팡이 코로나 때문에 휴직했던 직원을 해고했다는 이유로 고용법 소송을 당했다. 


이번 소송은 리버사이드시에 있는 물류시설인 쿠팡 풀필먼트 센터 직원이 제기한 것으로 이 센터에서만 지난 2019년 이후 벌써 6번째 제기된 노동법 위반 소송이다, 


리버사이드 카운티 수피리어 법원 케이스 번호 CVRI 2304681의 소장에 따르면, 쿠팡 글로벌(Coupang Global LLC)의 리버사이드 풀필먼트 센터의 전 직원 시드니 스미스는 지난 7일 쿠팡 글로벌과 인력회사 게리 넬슨 어소시에이츠 등을 상대로 부당해고 및 차별, 시간 외 수당 미지급, 식사 및 휴식시간 미제공, 임금명세서 미보복 등을 이유로 소송을 제기했다. 


한인 변호사 박지수 변호사가 포함된 원고 측 변호사들이 작성한 소장에서 해고 직원 스미스 씨는 지난 2020년 코로나 팬데믹 당시 자신의 건강과 안전 등을 이유로 코로나 휴직을 신청했다 복귀하지 못한 채 부당하게 해고를 당했다고 주장했다. 소장에서 스미스 씨는 “회사가 2020년 3월 직원회의 석상에서 팬데믹 상황으로 인한 휴직을 신청하더라도 불이익을 받지 않을 것이라고 공표했지만 코로나 휴직 이후 회사 출입이 거부된 채 해고됐다”라고 부당해고를 주장했다. 스미스의 주장은 자신에 대한 해고가 코로나 휴직을 갔다는 이유로 회사가 자신에게 가한 보복성 부당해고라는 것이다.




또, 코로나 휴직을 빌미로 자신을 해고한 것은 스미스의 나이로 인한 차별 때문이기도 하다고 소장에서 주장했다. 


소장에서 스미스는 쿠팡 글로벌의 리버사이드 풀필먼트센터 직원의 대다수가 25세 미만인 것을 보면 자신이 회사 측으로부터 연령 차별을 당한 증거라고 덧붙였다. 스미스 씨는 “팬데믹 기간 동안 고용주인 쿠팡은 직원의 안전과 건강에 대해 함께 상호작용을 하거나 대안을 배려하려 하지 않고 나를 보복성으로 해고한 것”이라며 “코로나 휴직에 대해 보복행위를 하지 않겠다는 회사 측의 발표와도 배치되는 것”이라고 밝혔다. 


코로나 휴직에 따른 보복성 해고뿐만 아니라 자기에게 식사시간과 휴식시간을 보장해주지 않았으며 기본임금과 시간 외 수당도 제대로 지급하지 않았다는 주장도 스미스는 제기했다. 소장에서 스미스는 회사 측은 5시간마다 30분간 제공하도록 규정되어 있는 식사시간을 제공해주지 않았으며, 4시간 근무마다 10분간 제공하도록 되어 있는 휴식시간도 보장하지 않았다고 주장했다. 


또, 스미스는 회사 측의 괴롭힘과 차별에 대해 자신이 정당한 법적 권리를 주장하자 회사 측이 적대적인 대우와 부당한 보복 조치를 취한 것이라며 명백한 캘리포니아 공정 고용 및 주거법 (FEHA) 위반이라고 주장했다.

상해보험 클레임한 변호사들 형사재판 진행중

많은 한인 고용주들을 대상으로 상해보험 클레임들을 제기했던 상해보험 전문 변호사들이 오렌지카운티 검찰에 기소되어서 유죄 판결을 받고 징역형을 살았거나 항소법원에서 재판을 받고 있다.

지난 2017년 6월 오렌지카운 티 검찰은 종업원 상해 보험 사기 혐의로 변호사 10명과 브로커 3명, 척추신경의 사 4명을 무더기로 기소했다. 이와 관련한 예비 심문이 1년여 만인 지난 2018년 6월에 처음 열렸 는데 그 이후 일부 피고들만 유죄 판결을 받았고 나머지는 진행중이다. 기소장에 따르면 이들은 지난 2011 년부터 2014년 사이 4년간 3만 3천여명의 종업 원들을 통해 보험회사에 3억 달러의 거짓 보험액을 청구한 혐의 를 받고 있다.

기소된 변호사 10명 가운데 한인은 없지만 이 가운데 대표적인 상해보험 전문 변호사인 올해 78세 데니스 푸지 변호사는 한인 부인이자 사무장인 김영애씨를 통해 그동안 한인 언론에 많이 광고를 냈다. 그리고 기소된 변호 사들이 종업 원상해보험 소송을 제기한 대상은 주로 한인 고용주들이고, 상해보험 클레임을 당해 상해 보험금을 지급한 업주 들도 많다.
기소됐던 10명의 변호사들 가운데 9명이 필자가 맡고 있던 한인 고용주 케이스의 원고 측 변호사들인데 한인 고용주들을 상대로 클레임을 제기했었다. 오렌지카운티 검찰의 보험 사기반은 이들로 부터 클레임을 당한 상해 보험사와 협력해서 이들 변호사와 주변 브로커들을 기소했다.

기소된 상해보험 변호사들은 LA와 오렌지카운티 등에서 활동하는 존 우즈, 페이먼 자가리, 존 잰슨, 파리 르자이, 리오넬 기르온, 데니스 푸지, 호르헤 레이예스, 로니 바숨, 로버트 슬래이터, 로빈 제이콥스 등 총 10명인데 이 가운데 어바인 소재 변호사인 르자이는 올해 6월 자살했다.

이들 중 로버트 슬레이터는 유죄 판결을 받았고, 필자의 클라이언트들을 상대로 수많은 상해보험 클레임을 했던 존 우즈는 지난해 8월 37개 항목에 걸쳐 유죄 판결을 받아서 4년형과 70만 달러의 벌금형을 받았다.

그러나 지난 2022년 1월28일 재판이 시작된 푸지, 자가리, 잰슨 변호사 케이스는 지난 8월31일 무죄로 판결 내렸고, 제이콥슨은 오는 10월3일 그리고 레이예스와 바숨은 오는 11월13일에 결정된다. 그러나 지난해 1월 22일 무죄 판결이 내려졌던 기르온에 대해 검찰이 항소를 했기 때문에 나머지 무죄 케이스들도 항소할 전망 이다.

오렌지카운티 검찰은 기소된 변호사들과 브로커들 사이의 조직적 결탁을 수사했다. 즉, 두 명의 브로거들은 지난 2005년 ‘센트로 리걸 인터네셔널’이라는 회사를 설립한 뒤 전문 브로커인 ‘캐퍼(capper)’로 활동했다. 이들이 변호 사들과 계약을 맺고 종업원들을 찾아 알선하 고 그 대가로 수령한 보험금의 9~20%를 변호사로부터 받았다. 캐퍼 들은 주로 히스패닉 종업원을 상대로 명함 과 광고 전단을 뿌리며 상해보험 신청자를 모집했 고 이들은 많은 한인 고용주들을 상대로 클레임들을 제기했다. 이 브로커들은 연방교도소에 각각 4년과 5년형을 복역하고 있다.

이번 사건을 맡고 있는 오렌지카운티 검찰에는 낸시 송 한인 검사도 포함되어 있는데 검찰측은 변호사가 캐퍼 등을 통해 소송 신청자를 알선 받는 것은 불법이라고 봤다. 심지어 이들은 신청자가 변호인을 만나지도 않은 상태에서 서류 신청을 대리하고 서명까지 받는 등 불법 행위를 감행하며 마구잡이로 보험금을 청구했다는 게 검찰 측 주장이다. 만약 유죄가 인정되면 변호사들은 죄질에 따라 7~26년형을 선고받을 수 있다.

이들이 벌금형을 통해 지불한 벌금들을 얼마나 보험회사들이 회수하고 그 가운데 얼마나 거짓 클레임을 당한한인 고용주들에게 크레딧으로 적용될 지는 모르지만 이번 항소 재판 결과가 보험금을 이미 지불한 한인 고용주

들에게 어떤 영향을 미칠 지 귀추가 주목된다. 종업원이 거짓으로 상해보험 클레임을 제기 했을 경우 변호사까지 형사법으로 기소될 수 있다는 판례가 남는다면 거짓 상해보험 클레임이 줄어들 것이기 때문에 한인 고용주들에 게 많이 유리할 것으로 전망된다.

LA 다운타운 자바시장의 한 대형 의류업체 인사담당 매니저 황모씨는 최근 실업수당을 관할하는 캘리포니아주 고용개발국(EDD)로부터 회사를 사직하고 실업수당을 청구했던 한 라티노 직원이 회사를 그만 둔 이유를 설명해 달라는 전화를 받았다.

회사를 떠난 직원은 해고가 아니라 본인 스스로 그만둔 경우였는데 그 직원이 EDD에 실업수당을 신청하면서 해고라고 명시한 반면 회사는 EDD에 보내는 서류에 사직이라고 표시했다는 것이다. EDD측에서 워낙 꼬치꼬치 사실관계를 캐물어 황씨는 진땀을 흘려야 했다.

직장에서 해고를 당해야만 받을 수 있는 실업수당을 직원이 받을 수 있게 하려는 선의의 마음에서 퇴직 사유를 사직이 아닌 해고라고 허위 답변할 경우 실업수당 허위 신청으로 업주 역시 벌금 뿐만 아니라 징역형까지 선고받을 수 있어 주의가 요망된다.
김해원 노동법 변호사는 “EDD는 직원이 실업수당을 신청하면 업주에게도 직원이 스스로 그만두었는지 아니면 해고됐는지 여부를 확인한다”며 “직원의 청구 내용과 업주의 답변이 다르다면 EDD는 업주를 상대로 전화 인터뷰를 실시한다”고 설명했다. 경우에 따라선 EDD가 청문회(hearing)를 요청하기도 한다.

김 변호사는 또 “한인 업주들은 스스로 그만 둔 직원이 실업수당을 받을 수 있도록 도와주기 위해 EDD에 직원이 해고당했다고 기재하는 경우가 많은데 이는 엄연한 불법행위”라고 강조했다. EDD가 주의 깊게 들여다 보는 실업수당 허위 청구 사례는 직원이 직장에 복귀한 뒤에도 EDD에 보고하지 않고 계속해서 실업수당을 수령하거나, 직원 혹은 업주가 EDD에 거짓 정보를 제공하는 것 등이다.

특히 EDD는 위조와 위증, 음모 등의 유형을 면밀하게 검토하는데 사직한 직원에 대해 고용주가 해고라고 거짓 정보를 제공할 경우 위증죄에 해당된다. 그리고 업주가 불법인 줄 알면서도 의도적으로 직원의 실업수당 허위 수령에 동조하는 것은 보험사기(fraud) 행위이기 때문에 중벌을 받을 가능성도 있다.

만약 업주가 청문회에 참석하지 않거나 대응하지 않을 경우 실업수당 청구 액수가 많고 적고에 상관 없이 직원의 실업수당 사기에 회사가 공범으로 엮이게 된다. 팬데믹 기간 동안 실업수당 사기가 급증하면서 EDD는 2021년에서 2022년 사이에 허위 청구로 의심되는 1,400건을 조사해 370명을 체포하고, 130명을 기소했을 정도로 주정부의 적발 의지는 강하다.

김해원 변호사는 “아무리 고용주가 선의의 의도를 갖고 있다 하더라도 직원의 퇴직 사유에 대해 대해 거짓말을 하면 처벌을 받게 된다”면서 “직원이 해고를 당했는지 아니면 스스로 그만뒀는지를 EDD에 분명하게 보고할 필요가 있다”고 조언했다.

떼강도 등 치안에 대한 비난으로 사면초가에 빠진 조지 개스콘 LA카운티 검사장이 물타기에 나섰다. 개스콘은 지난 6일 캘리포니아주 노동청과 가진 공동 기자회견에서 체불임금을 전담수사하는 ‘노동정의국’(LJU) 신설을 발표하고 하필이면 그 첫 대상으로 한인업주들을 기소했다.


개스콘의 떼강도 물타기 작전이 얼마나 필사적이냐 하면 무죄 추정의 원칙이 있는데도 불구하고 한인업주들이 마치 유죄인 것처럼 발표한 것이다. 형사소송의 피고인은 사법부에서 유죄판결이 확정되기 전까지는 무고한 사람으로 추정되는데 다급하게 LJU 발표에 맞춰서 기소한 것이 너무나 확연했다. 이 부서의 발표 타이밍도 웃기는 것이 이 한인업주들은 오래 전부터 노동청에서 조사 중이었고 기소만 지금 한 것인데 지난 2021년 말부터 LA 검찰과 노동청이 공조하기로 한 것이 무슨 상관이고, LJU 신설이 무슨 의미가 있는지 이해가 안 된다.


최근도 아니라 지난 2017년부터 임금체불을 저질렀다는 이 한인업주들의 죄목도 체불임금뿐만 아니라 그동안 노동법 수사에 거의 적용을 안 했던 위증과 음모 혐의가 추가됐다. 이미 캘리포니아주는 지난해부터 'AB 1003'에 근거해 고용주의 임금착취 행위를 중절도(grand theft)로 취급해 체불시 형사상 책임을 지울 수 있다.


정치인들이 가장 즐겨하는 일 중 하나가 부서 이름만 바꿔서 신선한 척하는 것인데 LJU도 새로운 업무를 하는 것이 아니다. 그 한 예로 캘리포니아주 공정고용주택국도 지난해 7월부터 민권국(CRD)으로 바꿔서 포스터나 자료 등을 변경해야 하는 세금낭비를 거쳤다.


이날 기자회견에는 연방노동부 장관 출신인 힐다 솔리스 수퍼바이저의 한인 보좌관인 에스더 림씨도 참석해 개스콘, 노동청장에 이어 마이크를 잡았다. 캘리포니아주에서 임금체불에 대해서 보도자료가 나갈 때마다 2017년 보고서를 인용하면서 '1년에 체불임금 금액이 80억달러'라니 '시간당 6달러를 받고 일했다'니 하면서 근거 없는 선동이다.


개스콘 검사장은 이날 기자회견에서 “LA는 미국에서 임금절도의 중심지”라며 “앞으로 임금절도에 대한 형사기소가 더 많아질 것”이라고 경고했다. 그런데 이 기사에 대한 한인들의 반응들이 재밌다. 즉, “업주들이 돈 주고 만든 옷을 훔치는 건 불법이 아니니 놔 주고 만든 사람은 중범이라. 여기가 멕시코이구나.” “약탈과 강도로 치안이 무너지는 상황에서 시민들의 안전보다 돈 뜯을 핑계만 찾는 개스콘. 하긴 도둑잡아 넣어야 돈이 되겠냐? 역시 민주당답다.”


개스콘의 물타기를 보면 마치 정우성, 조인성이 주연한 영화 ‘더 킹’에 나오는 비디오 테이프가 연상된다. “이거 터지면 대한민국 뒤집어 진다”는 여배우의 사생활에 대한 테이프는 검찰이 필요할 때마다 공개하는 물타기 작전용이다.


캘리포니아주 뉴섬 주지사는 지난 2021년 말 범죄와의 전쟁을 선포하면서 3억달러 규모의 예산을 투입했는데 떼강도는 더 심해졌고 주지사의 정치적 고향인 샌프란시스코는 위험한 도시가 됐다. 지난 14일에 주지사는 소매업체들을 대상으로 하는 범죄를 근절하기 위해 2억6700만달러를 또 투입한다고 발표했다. 그러나 개스콘은 떼강도가 체포되어도 금방 풀려나는 현행 보석금법에 대해 아무런 대책도 세우지 않고 있다.


이번 기자회견으로 인해 그동안 한인 봉제와 의류 업계의 불법관행이 멈춰지기를 바랄 수는 없다고 본다. 그러나 한인 의류, 봉제 업계가 스스로 법을 준수 못 해서 외압에 의해 억지로 지킬 수밖에 없는 이런 악순환이 안타까울 뿐이다. 문의 (213) 387-1386
